Terms & Conditions
For all workshops, masterclasses, trainings, courses, mentoring sessions, ceremonies, online and in person sessions.
This Agreement is made on the date of Application.
BETWEEN:
The Temple of Shamanic Magick a trade mark of Primal Shaman PTY LTD (“hereinafter referred to as TTOSM”).
and
The participant outlined in this application form (hereinafter referred to as “the Participant”).
By submitting the signup form to reserve a place in this workshop, the Participant is indicating that he/she has read and agreed to these terms and conditions.
In consideration of the Participant being accepted in and participating in a TTOSM class, workshop, ceremony or event, the Participant hereby accepts the following terms and conditions:
The Participants reservation for a place in this TTOSM class will be considered accepted upon receipt of the non refundable deposit indicated. Full Payment must be made before participation, unless a payment plan has been arranged before hand.
The Participant acknowledges that if any of the following applies to the Participant, TTOSM recommends that the Participant does NOT attend this event:
The Participant has been diagnosed or hospitalised for a mental health condition
The Participant is currently being treated for a mental health condition, trauma or PTSD
The Participant has taken or is currently on medication for mental illness
The Participant has had a psychotic episodes or mental instability
The Participant has mental illness in their family
The Participant has rage/anger outbursts that they cannot control
The Participant is pregnant
The Participant is weak physically
The Participant hereby acknowledges that none of the above conditions applies to them, or they have sought the proper medical guidance from their GP and have written approval to attend this event.
The Participant acknowledges that all TTOSM information, techniques taught, and advice given, are intended for educational and entertainment purposes only. This workshop is not intended to replace the services of a physician, or to provide an alternative to professional medical diagnosis or treatment. It is not intended to provide an alternative to all other relevant professional advice. It’s not intended to take you away from your current health programme. It is not intended to diagnose, treat, cure or prevent any disease or condition. If you think you have any type of medical condition you must seek advice from your physician.
The Participant agrees to always consult his/her physician and other relevant professionals before implementing any of the suggestions or rituals from TTOSM, practising any technique or applying any information from TTOSM.
Your safety is our priority. The Participant is responsible for making the final judgement to determine whether the environment, condition and situation (personal or environmental) are safe for the Participant to practice, or continue to practice any technique the Participant learned from TTOSM.
The Participant agrees that TTOSM Practitioners are not responsible and have no liability whatsoever for any damage, injury or negative effects relating in any way to the application of the information provided by TTOSM courses.
If the Participant completes payment before the event but Cancels up to 2 weeks before the event, TTOSM will honour a full refund (minus the deposit), and half a refund for cancellations up to 1 week before the event. If the Participant cancels on the day before the event or is a no show, the Participant agrees that they will not receive any refund. No refunds are given once the programme, workshop or training has commenced.
TTOSM also takes no responsibility for cancelled or delayed flights to / from the events or in the rare case that TTOSM has to cancel or change dates of the event due to circumstances out of TTOSM’s control eg natural disasters.
PARTICIPANT COVENANTS
I hereby agree to the following:
I acknowledge that the techniques and methodologies of TTOSM are unique to it and are not taught elsewhere or by other parties.
I acknowledge the uniqueness of the TTOSM training techniques and methodologies and the intellectual property Primal Shaman owns and licences in same.
I will not teach any aspect of the TTOSM techniques and methodologies. If I am interested in becoming a teacher, I will approach TTOSM and find out what is required.
I will not share or distribute any aspects of the TTOSM techniques and methodologies with any other party or entity.
I am not able to copy or distribute any TTOSM material or documentation shared online or in person until authorised by TTOSM in writing to do so.
I am not able to discuss any TTOSM material with others whether in person or online or via any communication or social media platforms until authorised by TTSOM in writing to do so.
I accept that in participating in TTOSM training; I hold TTOSM harmless for any losses I may sustain, howsoever arising.
I agree to pay TTOSM for all agreed fees and costs when due and payable. If the services of a debt collector are necessary I agree to pay for those.
I agree to indemnify TTOSM for any loses that it may sustain howsoever arising from me breaching any of the covenants herein.
I agree that this Agreement will be governed by the laws of Victoria and all applicable laws of the Commonwealth of Australia.
Please note the copyright for any live or online presentation is owned solely by or licensed to Primal Shaman. This material is provided for your personal use and development only. It may not be sold, shared without express written permission, or used in any way that competes with our business interests. TTOSM’S ZERO TOLERANCE BEHAVIOUR POLICY
I accept that TTOSM:
(a) has responsibilities to all its participants;
(b) has a zero-tolerance policy to participant behavioural issues; including and amongst other things; causing nuisances and being intoxicated or being affected by drugs;
(c) due to (a) and (b) above may unilaterally require me to leave any training and if so, I have no rights to any refund;
(d) shall be the sole arbitrator of any behavioural issue involving myself.
By taking any training with TTOSM you agree to these terms and conditions.

COMPETITION AND CONSUMER ACT
For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), Primal Shaman’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.
You must be over 18 years of age to use this website and to purchase any goods or services.
DELIVERY OF GOODS
Physical goods may be delivered by Australia Post and/or other reputable courier companies. Deliveries are processed promptly upon receipt of full payment. Delivery may take between 2 and 14 days, depending on the delivery option. Damaged or lost orders should be resolved with Australia Post or the courier company directly and we are not responsible for goods that are damaged in transit or not received. Replacement of damaged or lost items is made at the discretion of thetempleofshamanicmagick.com.au
Digital goods are delivered immediately. Please be aware there are inherent risks associated with downloading any software and digital goods. Should you have any technical problems downloading any of our goods, please contact us so we may try to assist you.
CANCELLATIONS AND REFUNDS
Primal Shaman handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.
Each Event has specific terms and conditions for when you sign up. Please review those upon booking. In general, should you wish to cancel attendance to an event or session, up to 2 weeks before the event, Primal Shaman will honour a full refund (minus any deposit), and half a refund for cancellations up to 1 week before the event. If you cancel on the day before the event or are a no show, you will not receive any refund. All programmes have a no refund policy. No refunds are given once the programme, workshop, mentoring or training has commenced.
LINKS TO OTHER WEBSITES
Primal Shaman may from time to time provide on its website, links to other websites, advertisements and information on those websites for your convenience. This does not necessarily imply sponsorship, endorsement, or approval or arrangement between Primal Shaman and the owners of those websites. Primal Shaman takes no responsibility for any of the content found on the linked websites.
Primal Shaman’s websites may contain information or advertisements provided by third parties for which Primal Shaman accepts no responsibility whatsoever for any information or advice provided to you directly by third parties. FITNESS AND EXERCISE
Exercise and health are matters that vary from person to person. You should understand that when participating in any exercise or exercise program, there is the possibility of physical injury. If you engage in this exercise or exercise program, you agree that you do so at your own risk, are voluntarily participating in these activities, assume all risk of injury to yourself, and agree to release and discharge Primal Shaman, all its instructors, commentators and any associated with the thetempleofshamanicmagick.com website from any and all claims or causes of action, known or unknown.
